The supreme court has affirmed Ademola Adeleke as the authentic governorship candidate of the Peoples Democratic Party (PDP) for the Osun election.
Dotun Babayemi, PDP governorship hopeful, had filed an appeal at the apex court challenging the affirmation of Adeleke’s candidature by a lower court.
Adeleke won the PDP governorship primary election conducted by the party’s national working committee (NWC) in April while Babayemi was declared winner in a parallel primary election.
But Adeleke was the recognised PDP candidate for the election and he went on to win the Osun governorship election in July.
Babayemi challenged Adeleke’s candidature at a lower court, but his suit was thrown out.
On Thursday, a five-member panel led by Justice Amina Augie dismissed the appeal on the grounds that the court lacks the jurisdiction to hear the case.
The could held that the expected time for filing the suit had elapsed.
