The appeal court in Abuja has affirmed David Umahi, governor of Ebonyi, as the senatorial candidate of the All Progressives Congress (APC) for Ebonyi south senatorial district.
On Friday, the court dismissed an appeal by Ann Agom-Eze and set aside the judgment of the federal high court.
It held that the lower court erred in upholding Agom-Eze’s counter-affidavit and failed to uphold the primary election of June 9, 2022, which produced Umahi as the APC senatorial candidate.
The court held that the governor’s nomination was never challenged within 14 days as prescribed by section 285(9) of the 1999 constitution.
A lower court had recognised Agom-Eze who came second in the May 28 primary election as the candidate, but ordered a re-run of the exercise within 14 days.
Umahi won the rerun election, polling 268 of the 275 votes cast, but his victory was contested in court.
